Terms of Use

1.1 These Terms of Use govern your access to and use of the TEAMITAPP mobile and web applications, sites, products and services together called the Services.

1.2 In these Terms, TEAMITAPP and the terms we, us and our refer to MountBL LLC, a company organized under the laws of the State of New Jersey, United States of America.

1.3 By creating an account, accessing or using the Services in any way, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

1.4 We may also publish additional policies such as a Privacy Policy, community rules and acceptable use guidelines. Those documents are incorporated by reference into these Terms and form part of the agreement between you and us.

2.1 The Services are intended for individuals who are at least fourteen years old.

By creating an account, you represent and warrant that

a. you are at least fourteen years of age, and

b. if you are between fourteen and seventeen, you are using the Services with the knowledge and consent of a parent or legal guardian, and

c. you are able to enter a binding contract under the laws that apply to you.

2.2 You must provide accurate and complete information when creating your account and keep that information current. You are responsible for all activity that occurs under your account.

2.3 You are responsible for maintaining the confidentiality of your login credentials. If you believe someone else has accessed your account, you must notify us promptly through TEAMITAPP support channels.

2.4 We may refuse registration, suspend or terminate accounts or restrict access to the Services where we reasonably believe these Terms have been or may be violated or where we consider it necessary to protect the safety or integrity of the platform or its users.

3.1 TEAMITAPP is a platform that enables users to create, find and join sports related and social events. Users who create events are called Hosts. Users who sign up to attend events are called Participants.

3.2 We are not a party to any agreement between Hosts and Participants. Hosts provide and operate their events directly to Participants. We do not control and are not responsible for the conduct of users or the content, quality, safety or legality of events.

3.3 Any terms, conditions, rules or policies established by a Host for a particular event are solely between the Host and the Participants. We do not guarantee that any event will occur, that it will be safe, or that it will meet your expectations.

3.4 TEAMITAPP is not a travel organizer, tour operator, sports instructor, coach, guide or insurance provider. We do not carry out background checks or vetting on every user or every event, and any limited checks we do conduct do not guarantee the accuracy, safety or suitability of any user or event.

4.1 Hosts are solely responsible for the events they create. This includes the planning, content, safety, legal compliance and overall execution of the event.

4.2 When you act as a Host, you are responsible for ensuring that any information you choose to publish about your event in TEAMITAPP such as date, time, primary meeting location, price and important conditions is accurate, current and not misleading.

4.3 Hosts must ensure that their events and their conduct comply with all laws, rules and regulations that apply to the event location and activity, including any permits or permissions that may be required.

4.4 Hosts are solely responsible for any obligations they may have toward Participants under consumer protection, health and safety or other applicable laws. We are not responsible for a Host's failure to comply with those obligations.

4.5 If you host events for commercial or professional purposes, it is your responsibility to comply with any registration, tax, licensing or insurance requirements that may apply to you in that capacity.

5.1 Participants are responsible for deciding whether an event is suitable for them. When you sign up for an event, you acknowledge that your decision is based on the information provided in the event listing and your own assessment.

5.2 You are responsible for reading and understanding the event description, host rules, cancellation policy, equipment requirements and any other conditions before signing up. If you have questions or need clarifications, you should contact the Host before committing.

5.3 You are responsible for your own transportation to and from the event and for your personal belongings and equipment during the event unless the Host clearly agrees otherwise.

6.1 Activities offered through TEAMITAPP often involve physical exercise, outdoor environments or other conditions that carry inherent risks. This may include risk of injury, illness, property damage, accidents or other harm.

6.2 You are solely responsible for evaluating your own physical and mental fitness for any event or activity. TEAMITAPP does not provide medical advice. If you have any doubt about whether an event or activity is appropriate for you, you should seek independent advice before participating.

6.3 You are responsible for bringing and using appropriate clothing, footwear, protective gear and equipment and for complying with all safety instructions, local rules and regulations that apply to the event or venue.

6.4 By participating in any event or activity found through TEAMITAPP, you understand and voluntarily accept all risks associated with that event and related activities, including travel to and from the event.

6.5 To the fullest extent permitted by law, you agree that we are not responsible for any injury, loss, claim, damage or expense that arises from or relates to your participation in events or activities organized or promoted by Hosts through the Services.

7.1 TEAMITAPP uses location related information for two main purposes

a. to help show you events that are near you and to apply distance filters that Hosts choose for their events, and

b. to allow you to check in at events and to verify that you were present for attendance tracking.

7.2 Hosts may choose to make certain events visible only to users within a selected distance of the event location. In those cases, whether an event appears in your search results may depend on approximate location information from your device.

7.3 During the time window for check in, TEAMITAPP may request access to your device location in order to confirm that you are reasonably close to the event location. This data is used to determine whether the check in is valid and is not retained beyond what is necessary for that purpose.

7.4 Other users cannot see your live device location through TEAMITAPP. The Services may show that you are attending or have attended an event and may show the event location itself, but not your real time device position.

7.5 If you disable location permissions, some features of TEAMITAPP may not work correctly. For example, you may not see nearby events based on distance filters and you may be unable to complete check in.

7.6 Further details about how we collect, use and protect location information are described in the TEAMITAPP Privacy Policy.

8.1 User Content means any information, text, photos, videos, profiles, reviews, comments, messages, event descriptions, host rules and any other material that users submit, upload or otherwise make available through the Services.

8.2 You retain any ownership rights that you have in your User Content. However, by submitting User Content through the Services, you grant us a worldwide, royalty free, transferable and sublicensable license to use, host, display, copy, reproduce, process, adapt, publish and distribute that content for the purposes of operating, improving and promoting the Services.

8.3 This license allows us, for example, to

a. display your event listings, profile, photos and reviews within the app and on related websites,

b. use screenshots or excerpts of your content in marketing materials that explain or promote TEAMITAPP, and

c. analyze User Content in order to improve recommendations, search results and other features.

8.4 You represent and warrant that you have all rights necessary to grant this license and that your User Content is truthful and not misleading, does not infringe any copyright, trademark, privacy, publicity or other legal rights of any person or entity, and complies with these Terms and all applicable laws.

8.5 We have no obligation to monitor User Content but may review, remove, edit or restrict access to any User Content at any time where we believe that the content may violate these Terms, applicable law or be harmful to users or third parties.

9.1 Program name: The SMS program is called “TEAMITAPP Event Notifications”.

9.2 Program description: By providing your mobile number and choosing to receive SMS messages, you agree that TEAMITAPP may send you text messages related to your use of the Services. These messages may include confirmations when you sign up for an event, reminders about event time and location, updates about changes or cancellations, and important account or safety alerts.

9.3 Message and data rates: Message and data rates may apply. We do not charge additional SMS fees, but your mobile carrier may apply standard messaging and data charges.

9.4 How to stop: You may opt out at any time by replying STOP to any TEAMITAPP SMS message or by adjusting your notification settings within the app.

9.5 Help: For help, reply HELP to any TEAMITAPP SMS message or contact us at support@teamitapp.com.

9.6 Supported carriers: Major US carriers are supported. Carrier support is not guaranteed for MVNO or international carriers.

10.1 The Services, including the TEAMITAPP name, logo, design, software, text, graphics and other materials, are owned by or licensed to us and are protected by intellectual property laws. You may not copy, modify, distribute, sell or exploit any part of the Services without our express written permission.

10.2 We grant you a limited, non exclusive, non transferable, revocable license to access and use the Services for your personal, non commercial use in accordance with these Terms.

When using the Services you must not:

12.1 The Services are provided on an as is and as available basis without any warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose or non infringement.

12.2 We do not warrant that the Services will be uninterrupted, error free or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any content on the Services.

13.1 To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or related to your use of the Services, including loss of data, loss of profits or personal injury.

13.2 Our total liability to you for any claims arising out of or related to these Terms or the Services shall not exceed the greater of one hundred US dollars or the amounts you have paid us in the twelve months prior to the claim.

You agree to indemnify, defend and hold harmless TEAMITAPP and its affiliates, officers, directors, employees and agents from any claims, liabilities, damages, losses or expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Services, your User Content, or your violation of these Terms.

We may update these Terms from time to time. When we make changes, we will update the date at the top. If the changes are material, we will provide more prominent notice, such as by sending you an email or displaying a notice in the app. Your continued use of the Services after the updated Terms take effect constitutes your acceptance of the changes.

16.1 You may stop using the Services and delete your account at any time through the app settings or by contacting us.

16.2 We may suspend or terminate your access to the Services at any time, with or without notice, for any reason including if we believe you have violated these Terms.

16.3 Upon termination, all licenses granted to you under these Terms will immediately end. Provisions that by their nature should survive termination, including those relating to intellectual property, disclaimers and limitation of liability, will survive.

17.1 These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict of law provisions.

17.2 Any dispute arising out of or relating to these Terms or the Services will be resolved by binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek emergency relief in a court of competent jurisdiction.

17.3 You agree to resolve disputes with us on an individual basis only and not as part of a class or representative action.
